Please read this agreement carefully before accessing or using this site and
listing with Catskill 4 Rent LTD. By accessing or using the site and listing
or renting, you agree to be bound by this agreement. The information and
services are provided by Catskill 4 Rent and its suppliers. By accessing and
using this site and Catskill 4 Rent’s services, you agree to the terms and
conditions below.
For Renters/Tenants
Catskill 4 Rent LTD assumes no responsibility for the accuracy of
information contained in the ads herein. It is suggested that potential
renters visit properties in advance to confirm all terms of their intended
rental. While we know that it is often difficult to do this, it is the only
method we know of for you to guarantee that your vacation rental will meet
your needs.
In lieu of visiting the property in advance, we advise renters to ask owners
in advance all their particular questions and concerns, prior to entering
into a rental agreement. At a minimum, be sure to receive in advance written
confirmation of the homeowner's policies on matters including advance
deposits, security deposits and cancellations, preferably in the form of a
rental agreement or lease.
Catskill 4 LTD and homeowners are not responsible for typographic errors.
Rates and conditions are subject to change without notice.
Renters are encouraged to inform Catskill4Rent LTD of any extraordinary
(good or bad) experiences they may have with any of the homes listed. Click

Information contained in advertisements is neither confirmed nor warranted
by CATSKILL 4 Rent LTD . Confirmation of information printed herein is the
responsibility of the renting party.
For the avoidance of doubt, your use to search for or inquire about vacation
rental properties makes you subject to our Policies. Catskill 4 Rent LTD is
not a party to any transaction between you and one of our advertisers and
you specifically agree to release and hold Catskill 4 Rent LTD harmless from
and against any cause of action arising from your transaction with one of
our advertisers.
Catskill 4 Rent is not responsible for the refund of rental fees for any
reason.
Renters assume all liability for use of any information found in the
Catskill 4 Rent Internet publication. By using or continuing to use the
services of Catskill 4 Rent you agree to the terms and conditions of this
disclaimer.
Links to Other Web Sites
This site may include links to other Internet sites solely as a convenience
to users. Catskill 4 Rent does not endorse any such sites or the
information, materials, products or services contained on or accessible
through the sites, and you access and use such sites, including nformation,
material, products and services therein, solely at your own risk.
Limitation of Liability (Owners and Renters/Tenants).
IN NO EVENT WILL Catskill 4 Rent LTD BE LIABLE FOR ANY DAMAGES, INCLUDING
WITHOUT LIMITATION ANY INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, OR
PUNITIVE DAMAGES ARISING OUT OF, BASED ON, OR RESULTING FROM THIS AGREEMENT
OR YOUR USE OF THE SERVICE, EVEN IF Catskill 4 Rent LTD HAS BEEN ADVISED
OF THE POSSIBLITY OF SUCH DAMAGES. THESE LIMITATIONS AND EXCLUSIONS APPLY
WITHOUT REGARD TO WHETHER THE DAMAGES ARISE FROM (1) BREACH OF CONTRACT, (2)
BREACH OF WARRANTY, (3) STRICT LIABILITY, (4) TORT, (5) NEGLIGENCE, OR (6)
ANY OTHER CAUSE OF ACTION, TO THE EXTENT SUCH EXCLUSION AND IMITATIONS ARE
NOT PROHIBITED BY APPLICABLE LAW. IF YOU ARE DISSATISFIED WITH THE SERVICE,
YOU DO NOT AGREE WITH ANY PART OF THIS AGREEMENT, OR HAVE ANY OTHER DISPUTE
OR CLAIM WITH OR AGAINST Catskill 4 Rent LTD WITH RESPECT TO THIS
AGREEMENT OR THE SERVICE, THEN YOUR SOLE AND EXCLUSIVE REMEDY IS TO
DISCONTINUE USING THE SERVICE.
For Home Owners
Terms and conditions of advertising on Catskill 4 Rent LTD’s Web page and
using Catskill 4 Rent LTD services.
1. Layout and copy:
1.1 Catskill 4 Rent reserves the right to determine the final design, layout
and functionality of our website which is subject to change from time to
time without notice.
1.2 Catskill 4 Rent reserves the right to edit copy or amend the layouts or
photographs supplied, in order to create a more uniform and pleasant
advertising environment for our visitors.
1.3 Catskill 4 Rent reserves the right, at its discretion, to amend and
edit copy entered into the Catskill 4 Rent online database by
owners/listers. All copy edits submitted by owners/listers are subject to
review and approval of Catskill 4 Rent in its sole opinion.
2. Accuracy
2.1 All listings on Catskill 4 Rent, as submitted by the owner/lister and
amended from time to time by Catskill 4 Rent staff, are the responsibility
of the owner/lister, and Catskill 4 Rent specifically disclaims any and all
liability arising from the alleged accuracy of the listings, or any alleged
breaches of contract on an advertiser's part. By accepting these Terms and
Conditions and paying to list on Catskill 4 Rent, you agree to indemnify and
hold Catskill 4 Rent and its affiliates harmless against all costs, expenses
and losses arising out of a claim relating to the content of an
advertisement.
2.2 Owners/listers are solely responsible for keeping their information up
to date on Catskill 4 Rent, including, but not limited to any and all
representations about the property, its amenities, location, and its
availability for a specific date or range of dates. Catskill 4 Rent makes no
representation or warranties that any of the copy or availability
information published on Catskill 4 Rent is accurate or up-to-date even in
the case where visitors have searched for specific special offers, dates, or
types of properties.
3. Photographs
3.1 Photographs are only accepted electronically in .JPG format. Printed
(paper based) photographs can not be submitted. Catskill 4 Rent is not
responsible for the quality of the photographs.
3.2 By submitting a photograph electronically through our website, the
Owner/lister is representing an warranting that (a) he holds all
intellectual property rights with respect to each submitted photograph, or
(b) he has secured from the copyright holder all rights necessary for the
photograph to be used in an online advertisement, and (c) that any people in
the photograph have given permission for their likeness to be displayed in
an online advertisement, and (c) that the photograph accurately and fairly
represents the subject of the photograph and has not been altered in any
manner that would mislead a viewer of that photograph and (d) that he will
indemnify and hold harmless Catskill 4 Rent and its affiliates from any
cause of action arising from any misrepresentation with respect to any and
all the photographs so submitted.
4. Liability
4.1 Catskill 4 Rent does not warrant that the operation of the Catskill 4
Rent site will be uninterrupted or error-free.
4.2 In no event shall Catskill 4 Rent be liable to the advertiser for any
special, consequential, incidental or indirect damages, including lost
profits.
4.3 In no event shall Catskill 4 Rent LTD be liable for failure of a tenant
of paying the agreed about fees and rents nor for any damages to any part of
the rental property of any kind caused by a tenant.
5. Copyright
5.1 By accepting these Terms and Conditions and by paying and posting a
listing on Catskill 4 Rent, the Owner/lister grants to Catskill 4 Rent and
its affiliates a fully paid up license to use the copy, the photographs, the
likenesses (if any) on its website or the websites of its affiliates and
grants Catskill 4 Rent the ability to copyright and protect the images,
copy, and information available via the Owner/lister’s listing from the
unauthorized use by unaffiliated third parties who may, from time to time,
attempt to pirate such information via electronic or other means. Catskill 4
Rent is not responsible for any infringement of copyright laws resulting
from material supplied by the Owner/lister and the Owner/lister indemnifies
Catskill 4 Rent against any action brought for breach of copyright or other
rights from the use of such material supplied by the advertiser.
5.2 Catskill 4 Rent shall be entitled to reproduce part or whole of any
photographic material supplied by the advertiser in the promotion of either
the Owner/lister’s property or the promotion of Catskill 4 Rent.
6. Termination of advertising
6.1 All listings are sold to run the full period that is chosen by the
Owner/lister with a minimum of 1 year. Listings removed at your request
prior to the completion of their full run area not subject to a refund.
6.2 Catskill 4 Rent reserves the right to refuse any listing submitted to
Catskill 4 Rent sent to our office for us to load onto the website. We can
refuse to publish the ad for no reason, and you specifically agree to hold
us harmless for any loss or liability that may arise from such a decision.
6.3 If Catskill 4 Rent receives a complaint from a person who has rented an
lister’s property which Catskill 4 Rent, acting reasonably, considers to be
justified, or if you double-book a property for multiple renters on the same
date, or if you engage in any business practice that would be considered
within the vacation rental industry to be unfair, or if you are in breach of
your obligations to Catskill 4 Rent, then Catskill 4 Rent reserves the right
to remove the property from the Catskill 4 Rent web site without notice.
7 Payment
7.1 Payment for listings must be made in U.S. Dollars paid either by money
order or a check drawn on a U.S. bank. No listing will be posted without
payment.
8 Legal jurisdiction
8.1 Any and all Catskill 4 Rent services and products are performable
and/or sold in the State of New York, United States of America, and you
irrevocably agree to that any cause of action you may submit will be filed
in Delaware County, New York which will be the venue of any legal dispute.
You also agree that any dispute will be governed by the laws of the State of
New York. |
